EXCLUSIVE: Former Tallassee police officer indicted on assault charge

TALLAPOOSA COUNTY, AL (WTVM) –

A former Tallassee Police officer has been indicted by a Tallapoosa Co. Grand jury and turned himself into the detention facility on Wednesday.

Brandan Smirnoff, 23, is facing charges of third-degree assault. The former Tallassee police officer was investigated by the FBI and other agencies for alleged police brutality.

Tallassee Police Chief Jimmy Rogers confirmed the arrest and investigation. Chief Rogers couldn’t comment on specifics details of the incident, but said Smirnoff had been with the city police for more than two years.

In a statement, Rogers said: “The Police Department is working with the State Bureau of Investigations and the FBI in reference to a March incident in which an officer was allegedly involved in an arrest where excessive force was used. The state was able to provide information that resulted in the dismissal of the officer for violation of City policies. This is an unfortunate situation and actions of officers will be scrutinized if there is any indication of improper actions.”

Smirnoff’s first attorney, Susan James, told us Smirnoff denied the allegations when we first contacted her about the initial investigation. Smirnoff’s current attorney, Bill Lewis of Wetumpka, AL, sent this statement, saying:

We are aware of the charges against Officer Smirnoff and are in the process of obtaining and reviewing whatever evidence the state has against him.  Mr. Smirnoff maintains his innocence and based on what we have been provided and are aware of there is no evidence that substantiates the charge against him.
