Fullerton police officer pleads not guilty to filing a false police report

SANTA ANA A Fullerton police officer accused of filing a false report that contradicted body camera footage pleaded not guilty on Wednesday.

Miguel Siliceo, 51, of Anaheim was charged with one felony count of false report by a peace officer after prosecutors said he logged a report stating a man was resisting arrest when body camera footage from other officers at the scene showed otherwise.

If convicted, he faces up to three years in jail.

Siliceo’s attorney, Michael Schwartz, on Wednesday said the evidence is based solely on the video footage, which doesn’t show the entire incident.

“The video is a small piece of the whole picture,” he said.

Prosecutors said Siliceo was on patrol with his partner in downtown Fullerton in 2015, when he arrested a man for resisting arrest.

Prosecutors said they relied on Siliceo’s report when they charged the man with one misdemeanor count of resisting arrest, but a later review of body camera footage did not corroborate Siliceo’s arrest report.

Prosecutors dropped charges against the man and filed criminal charges against Siliceo.

Siliceo, who joined the Fullerton Police Department in 2006, was placed on paid administrative leave in October, pending the investigation, officials said.

The department is doing an internal affairs review and has declined to comment further on the case.

Schwartz said Siliceo previously served as an officer with the Tustin Police Department.
